Impartial values when a collection must be divided

Art is often one of the hardest assets to divide in a divorce. Spouses may see the same painting very differently, sentimentally and financially. Helmuth Art Advisory provides objective, well-documented fair market value appraisals that help both sides, their attorneys and the court reach a fair result under Florida's equitable distribution framework.

Why an independent art appraisal matters

  • Neutral numbers: a USPAP appraisal must be impartial, no matter which party engages it
  • The right type of value: fair market value, not insurance replacement figures that overstate what a work would sell for
  • Defensible reasoning: comparable sales and methodology documented clearly enough to be explained
  • Practical guidance: which works carry significant value, and which are primarily sentimental

What you and your attorney receive

  • A written report stating fair market value as of the effective date counsel specifies
  • Item-by-item identification, photographs and condition notes
  • A summary schedule suited to a financial affidavit or settlement negotiation

For family law attorneys

Austin works with counsel on scope, valuation date and deadlines from the start. A jointly retained appraisal is often the most cost-effective route. Where each side retains its own appraiser, the report is written to stand on its own methodology. [CONFIRM: litigation support / testimony availability]

Process

How it works

Attorneys are welcome to make the initial inquiry on a client's behalf.

  1. Send photos & details

Use the form to upload a few photos (front, back, signature, labels) and tell us what the appraisal is for.

  2. Quote & scope

Fees are quoted upon request, based on scope. You receive a written quote and a clear scope: purpose, type of value, effective date and what the report will include.

  3. Inspection & research

Austin examines the work in person or reviews documentation as the assignment requires, then researches comparable sales.

  4. Your written report

A USPAP-compliant report with descriptions, photographs, methodology and the value conclusion you need.

FAQ

Equitable distribution questions

What is an equitable distribution appraisal?

In a Florida divorce, marital assets are divided under the state's equitable distribution law. When those assets include art, the parties and the court need an impartial, documented value. An equitable distribution appraisal provides that value, usually fair market value as of a date set by agreement or by the court.

Can you work for both spouses?

Yes. A jointly retained, neutral appraiser can reduce cost and conflict. Austin can also be retained by one side through counsel. Either way the appraisal is impartial: USPAP requires the appraiser to be objective regardless of who pays.

Which valuation date is used?

That is a legal question for the attorneys. The appraisal will state the effective date it uses, whether that is the date of filing, a separation date or another date the parties agree on.

Will you testify?

[CONFIRM: is Austin available for depositions / expert testimony?] Fees for any testimony are quoted upon request, based on scope.

Is the process confidential?

Yes. Engagements are handled discreetly, and reports go only to the client and counsel unless you direct otherwise.
